Judge Nona L. Klippen will take a week to study evidence and make a decision on whether any or all charges against Reuben Foster will go to trial. That decision is set for May 23 at 3:30 p.m.

Foster's ex-girlfriend says she lied to 'end him'

49ers linebacker Reuben Foster's ex-girlfriend, Elissa Ennis, says she "lied a lot" about her allegations of domestic violence and that she wanted to "end him" while testifying at a preliminary hearing Thursday.

The Reuben Foster preliminary hearing has reached a noon recess and will re-convene at 1:30. Los Gatos Detective James Wiens just testified before the recess. Wiens said he did not follow up on the alleged fight in San Francisco involving Elissa Ennis and another woman because he did not know the location of it. He also said he had not looked into Ennis' past in Louisiana and was unaware of the 2011 incident in which she falsely accused a boyfriend of domestic violence after he broke up with her.

Elissa Ennis, Reuben Foster's ex-girlfriend, testified that she falsely accused a former boyfriend of domestic violence in 2011 after he broke up with her. Ennis said she felt the need to testify today because she "had to do the right thing." She completes her testimony after about two hours on the stand.

Elissa Ennis testified that in days after the Feb. 11 incident outside Reuben Foster's house she texted him making threats that she would end his career and "go after" the Niners and Foster's coaches. She also admitted to taking two Rolexes from Foster's home which she still has in a safe deposit box in Louisiana.

Elissa Ennis, Reuben Foster's former girlfriend, is still on the stand at another break. During questioning from defense, she broke down in tears as she testified that she lied about Foster harming her. "I'm sorry," Ennis said."I really am. I apologize to everyone." Judge cleared courtroom to allow Ennis to compose herself.

On why she lied to police initially about Reuben Foster putting his hands on her, his ex-girlfriend Elissa Ennis said "It was all a money scheme." Ennis testified that she never wanted Foster's case to get this far in the news and was hoping to sue Foster.

Also testifying at Reuben Foster's preliminary hearing Thursday morning was a man who was driving the car that Elissa Ennis stopped the morning of Feb. 11 to borrow his phone to call 911. He testified that he loaned Ennis his phone and that she seemed "calm" when she flagged him down. The witness said he spent about 15-20 minutes as Ennis made two calls from his phone.

Ennis testified at Reuben Foster's preliminary hearing against the advice of her attorney Stephanie Rickard. Rickard said she advised Ennis to take advantage of her fifth amendment right not to incriminate herself.

She testified that Foster never laid his hands on her and said her injuries were result of fight with woman that took place the night before the Feb. 11 incident in Los Gatos.

49ers linebacker Reuben Foster has an important date today as his preliminary hearing in domestic violence case reaches preliminary hearing stage. Foster's former girlfriend is expected to testify to story today, per the Sacramento Bee. The hearing is set for 9 a.m. PT and initially expected to take half the day.

The 49ers made a few minor roster moves on Tuesday, signing CB C.J. Goodwin and DL Blaine Woodson and releasing WR DeAndre Carter. Goodwin comes off waivers from the Giants while Woodson was a tryout player at the rookie minicamp.

The 49ers signed S Marcell Harris, a sixth-round draft pick, to his four-year rookie deal on Monday. Harris is the sixth member of the Niners' nine-man draft class to sign. Only OT Mike McGlinchey (first round), WR Dante Pettis (second round) and LB Fred Warner (third round) are unsigned.

The 49ers signed fifth-round DB D.J. Reed to his four-year rookie deal on Friday. Reed is the fifth member of the Niners' draft class to sign, joining DB Tarvarius Moore, DL Jullian Taylor, WR Richie James and DL Kentavius Street. Reed is an intriguing prospect, who should have a chance to compete for the nickel back job while offering the versatility to play free safety and return kicks.

The 49ers announced Wednesday that they've signed offensive lineman Mike Person. Person is a 7-year veteran who has experience playing all over the line. He also started at center for the Falcons when Kyle Shanahan was offensive coordinator there. After releasing Zane Beadles earlier this week, the Niners add Person, who brings similar versatility and will have a chance to compete for a depth spot.

Legal analyst Steven Clark, a former Santa Clara deputy district attorney, said Reuben Foster's preliminary hearing potentially moving to trial will depend heavily on whether Foster's accuser testifies to the story she told in her recantment. Clark said the purported video of the accuser in an altercation with another woman is the "center piece" of the case and will also go a long way in determining whether the case goes forward.

There's another hearing set for Friday in Reuben Foster's case which relates to a subpoena for evidence. Foster has been excused from having to appear on Friday and that hearing may not take place at all if evidence is supplied to both sides before then.
